Privacy Policy

§1 GENERAL PROVISIONS

1. This document defines the principles of processing personal data obtained from Customers by the California Trading Online Store, operated at www.california-trading.eu by California Trading Sp. z o.o. It also contains information regarding the use of cookies and analytical tools in the Online Store.

2. The controller of personal data is California Trading Sp. z o.o., entered into the National Court Register maintained by the District Court of Gdańsk-Północ in Gdańsk, 7th Commercial Division, under number 0001123557, Tax Identification Number (NIP): 6040076113, National Business Registry Number (REGON): 220447908.

3. Personal data collected by California Trading Sp. z o.o. via the Online Store are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (General Data Protection Regulation), hereinafter referred to as the GDPR.

4. The California Trading Store informs that Customers’ personal data will be processed solely for the purpose of executing and implementing the contract concluded with the Buyer/Customer. With additional consent, personal data will also be processed for the purpose of providing informational materials and marketing offers in the form of a newsletter.

5. The California Trading online store makes every effort to ensure respect for your privacy and the protection of the personal information provided when using and making purchases within the store, and for this purpose, among other things, a secure communication encryption protocol (SSL) is used.

6. Providing personal data is voluntary, however, failure to provide data marked as necessary will prevent registration or placing an Order.

§ 2 TYPE, PURPOSES, AND LEGAL BASIS FOR PERSONAL DATA PROCESSING

The California Trading Online Store collects personal data in the following cases:

1. In order to perform the contract for the sale of goods from the Store concluded with the Customer, related to the registration of an Account and placing Orders, – the basis for processing is Article 6 paragraph 1 letter b) of the GDPR (performance of the contract)

2. For the purpose of establishing, pursuing or enforcing claims – legal basis: Article 6(1)(f) of the GDPR
    1. In these cases, the necessary scope of data processed includes first name and last name; e-mail address; contact telephone number; address: street, house number, apartment number, postal code, town, country, address of residence/business/registered office, bank account number (in the case of returns), and in the case of Customers who are not consumers, additionally the company name and tax identification number – NIP and other data collected during the use of the Online Store.

3. Subscription to the newsletter (Newsletter), for the purpose of performing a contract for services provided electronically. Legal basis – consent of the data subject to the performance of the contract for the provision of the Newsletter service (Article 6, paragraph 1, letter a of the GDPR).
    1. In this case, the necessary scope of data processed includes the e-mail address and contact telephone number.

§ 3 SHARING PERSONAL DATA

1. For the Online Store to function properly, the Administrator must utilize the services of external entities. The Administrator ensures that it uses the services of data processors in a manner that is appropriate and consistent with applicable law, including the EU GDPR.

2. The Administrator transfers data only when it is necessary to achieve the purpose of processing and only to the extent necessary.

3. Customers’ personal data may be transferred to the following entities:
    – providers of hosting and ICT services,
    – carriers shipping Orders (listed in the Online Store Terms and Conditions),
    – entities handling electronic payments in the Online Store,
    – entities providing accounting, legal, and advisory services.

§ 4 PERSONAL DATA STORAGE PERIOD

1. The personal data provided will be processed for the period necessary to execute the concluded contract for the sale of Goods, including the Customer’s complaints and the pursuit or defense of claims by the Controller – but no longer than 10 years from the date of data transfer.

§ 5 PROFILING

1. The www.california-trading.eu Online Store may use the profiling function, which involves any automated processing of personal data that allows for the assessment of personal factors of a natural person, and in particular for the analysis or forecasting of aspects of Customer preferences and interests.

2. This feature will allow the Administrator to display advertisements tailored to the Customer’s preferences and interests and present products that best meet their needs. This feature will also enable the use of appropriate communication methods, including the selection of communication language.

3. The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or significantly affects him or her in a similar manner.

§ 6 RIGHTS OF THE DATA SUBJECT

1. The www.california-trading.eu Online Store may use the profiling function, which involves any automated processing of personal data that allows for the assessment of personal factors of a natural person, and in particular for the analysis or forecasting of aspects of Customer preferences and interests.

§ 6 PRAWA OSOBY, KTÓREJ DANE DOTYCZĄ

1. According to the GDPR, a person who provides their personal data has a number of rights, such as:
    1. The right to information on how personal data is processed,
    2. The right to access and update data,
    3. The right to withdraw consent – ​​legal basis: Article 7(3) of the GDPR,
    4. The right to object to the processing of personal data – legal basis: Article 21 of the GDPR,
5. The Customer has the right to object at any time – for reasons related to his/her particular situation – to the processing of his/her personal data, including profiling, if the Online Store [name] processes his/her data based on a legitimate interest,
6. The right to delete data, the so-called “right to be forgotten” – legal basis: Article 17 of the GDPR,
    7. The right to restrict data processing – legal basis: Article 18 of the GDPR,
    8. The right to data portability – legal basis: Article 20 of the GDPR,
    9. The right to lodge a complaint with the supervisory authority.

§8 COOKIES

1. The www.california-trading.eu online store uses cookies. These are small text files sent by a web server and stored by the browser’s computer software. When the browser reconnects to the website, the website recognizes the type of device the user is connecting from. These parameters allow only the server that created them to read the information contained within them. Cookies therefore facilitate the use of previously visited websites.

2. The Administrator uses its own Cookies for the correct configuration of the Store, and in particular to:
    1. adapting the content of the Store’s websites to the Customer’s preferences and optimizing the use of websites;
    2. recognizing the Store Customer’s device and its location and appropriately displaying the website, tailored to their individual needs;
    3. remembering the settings selected by the Customer and personalizing the interface, e.g. in terms of the selected language or region from which it comes;
    4. matching appropriate advertisements to the customer’s preferences;
    5. remembering the history of pages visited on the website in order to recommend content;
    6. font size, website appearance, etc.

3. The Administrator uses its own Cookies to authenticate the user in the Store and to ensure the maintenance of the user’s session on the website, and in particular to:
    1. maintaining the Store Customer’s session (after logging in), thanks to which the Customer does not have to re-enter the login and password on each subpage of the website;
    2. correct configuration of selected Website functions, enabling in particular verification of the authenticity of the browser session;
    3. optimizing and increasing the efficiency of services provided by the Administrator.

4. The Administrator uses its own Cookies to implement the processes necessary for the full functionality of the websites, in particular to:
    1. adapting the content of the Website’s web pages to the User’s preferences and optimizing the use of the Website’s web pages. In particular, these files allow for the recognition of the basic parameters of the User’s Device and the appropriate display of the website, tailored to their individual needs;
    2. correct operation of the affiliate program, enabling in particular verification of the sources of Users’ redirection to the Website’s websites.

5. The Administrator cooperates with the following external websites, which may place external cookies:
    1. Google Inc. based in the USA (including Google AdSense, Google Analytics, Google AdWords, Google Maps API, Google Doubleclick, Google Tag Manager, Google Search Console) More information https://support.google.com/google-ads/answer/2407785;
    2. Facebook Inc. based in the USA or Facebook Ireland based in Ireland;

6. The User may independently and at any time change the cookie settings, specifying the conditions for their storage and access by Cookies to the User’s Device. The User may change the settings referred to in the previous sentence using the web browser settings or by configuring the service. These settings can be changed, in particular, to block the automatic handling of Cookies in the web browser settings or to notify the User each time Cookies are placed on the User’s Device. Detailed information about the possibilities and methods of handling Cookies is available in the software (web browser) settings.

7. The user may delete cookies at any time using the functions available in the web browser he or she uses.

8. Restricting the use of cookies may affect some of the functionalities available on the Website.

§ 9 FINAL PROVISIONS

1. The Online Store Administrator reserves the right to change this privacy policy at any time and place and undertakes to immediately publish the new privacy policy on the Store’s website and inform all registered Users about it.

2. To the extent not regulated by this Privacy Policy, generally binding provisions on personal data protection shall apply.
